Terms & Conditions

Welcome to Wishop South Africa ("Wishop", "we", "our", "us"). These Marketplace Terms & Conditions ("Terms") govern your use of the online marketplace available at wishop.co.za (the "Platform"). By registering, browsing, placing an order, or offering products on Wishop, you agree to be bound by these Terms, together with any policies referenced herein (e.g. Privacy Policy, Returns Policy) and any seller-specific conditions.
Wishop operates a digital marketplace designed to connect Customers and third-party Sellers. Wishop provides a professional intermediation service that allows Customers to order products offered by Sellers. Wishop hosts Seller offers and facilitates the relationship between Sellers and Customers but acts only as a technical intermediary and does not manufacture, supply, or warrant those products. Products sold directly by Wishop are identified as such; otherwise, the Seller is the merchant of record.
1. Definitions
- Customer – any natural person or legal entity that registers on Wishop and places an order with a marketplace Seller.
- Seller’s Page – the page on the Platform where a Seller lists its products and displays information such as product catalogue, Seller-specific policies (including delivery, returns and exchanges), and Customer ratings & reviews.
- Customer Account Page – the secure interface hosted on Wishop containing all data provided by the Customer (order history, addresses, etc.). Access is via personal login details.
- Online Store / Product Page – pages on the Platform where a Seller’s offers are presented, including product images, price, characteristics, and other legally required information.
- Marketplace / Platform – the web platform accessible via wishop.co.za on which Sellers publish offers and Customers can order products.
- Offer – a commercial offer relating to a Product published by a Seller on the Platform.
- Parties – collectively, the Seller and the Customer involved in a Sales Contract.
- Product – any goods or services offered for sale on the Platform.
- Seller – a person or business with a presence in South Africa authorised to market Products on the Platform under these Terms.
2. Object
These Terms set out the rights and obligations of Customers and Sellers when they transact via Wishop. They form a binding contract between the Parties for every order placed on the Platform. Wishop’s role is limited to hosting Seller Offers and facilitating the Sales Contract; Wishop does not become a party to the Sales Contract and does not accept liability for the performance of that contract. Any sale of a Product via Wishop is ruled by these Terms and by any Seller-specific policies.
3. Acceptance of Terms
Customers must read these Terms carefully and accept them before paying for any order placed through Wishop. The Terms are accessible on Wishop’s website; Customers are encouraged to download and keep a copy. By clicking “Place Order” or similar at checkout, the Customer acknowledges having read, understood, and accepted these Terms without limitation.
4. Orders
4.1 Product attributes
Products and content published on Sellers’ pages are displayed under the sole responsibility of the Seller. Sellers must provide accurate and complete details of their Products. Customers must read this information carefully before placing an order.
4.2 Product selection and availability
Customers choose Products according to their needs. The Seller has 72 hours after receiving an Order to confirm availability. Only upon confirmation is the Sales Contract considered final. If a Product is unavailable, the order may be cancelled, and the Customer refunded.
4.3 Identification
Customers must log into their account to place and complete an order. New Customers may need to register before ordering.
4.4 Order validation
Once Products are selected, the Customer will see a summary of the order (products, prices, quantities). The Customer chooses a delivery method and then pays. Clicking “Place Order” constitutes acceptance of the Sales Contract.
4.5 Final order validation
Wishop transmits the order to the Seller. The Seller must confirm or reject the order within 72 hours. If rejected, Wishop refunds the Customer. Orders are considered final once the Seller confirms shipment. Sellers are responsible for issuing invoices when required.
5. Price
- Pricing – Selling prices are set by the Seller in compliance with South African law. Prices are in South African Rand (ZAR) and include VAT.
- Delivery fees – Delivery fees are separate from product prices and payable by the Customer unless stated otherwise.
- Applicable price – The applicable price is the one displayed on the Platform at the time the Customer places the order.
6. Payment
6.1 Payment methods
Customers can pay for orders via accepted cards (Visa, MasterCard) or other methods displayed at checkout. Some payment options may not be available for all Sellers.
6.2 Payment date
Payment is processed at the time of placing the order. Customers may cancel and request a refund within 14 days of delivery under Article 8.
6.3 Payment declined
If payment is declined, the order is cancelled and the Sales Contract automatically terminated.
7. Delivery
7.1 Shipping methods
Delivery is made according to each Seller’s terms. Products are delivered to the Customer’s specified address, typically to the building entrance or threshold.
7.2 Shipping lead times
Delivery times are calculated in calendar days from order confirmation. Deliveries are only available in South Africa. Sellers provide tracking numbers where possible.
7.3 Shipping fees
Shipping fees are indicated in the Seller’s offer.
7.4 Shipping delays
If delivery is delayed by more than 30 days beyond the expected date, the Customer may cancel the order. Refunds are made within 4 days if unshipped, or 14 days if the goods are returned after shipping. Customers must inspect goods upon delivery and report issues within 3 days, or within 10 days if inspection was not possible at delivery.
8. Right of Retraction
8.1 Retraction principle
Customers may cancel a marketplace purchase within 14 days of delivery without providing a reason. The Customer is liable for return shipping costs unless the Seller specifies otherwise.
8.2 Retraction method
The right of retraction expires 14 days after the Customer (or authorised recipient) receives the Product. Goods must be returned complete and undamaged.
8.3 Notification
The Customer must notify the Seller through the “My Orders” section of their Wishop account within 14 days of delivery.
8.4 Refunds
Sellers refund the Customer (including standard delivery fees) within a reasonable period after goods are returned or proof of return is provided. Return shipping costs remain the Customer’s responsibility unless otherwise stated.
8.5 Return modalities
Goods must be returned within 14 days of notifying retraction, with accessories and original packaging intact.
9. Warranty and After-Sales Service
Sellers may offer commercial guarantees in addition to statutory warranties under South African law. Sellers are responsible for fulfilling warranties and providing after-sales service. Customers must contact the Seller directly for warranty claims.
10. Responsibility
Wishop is a neutral intermediary and is not liable for a Seller’s breach of contract, defective products, or damages caused by a Seller. Sellers remain solely responsible for their Products and services. Wishop is not liable for delays or non-performance caused by force majeure. Illegal content must be reported to support@wishop.co.za , and Wishop will act promptly to remove such content.
11. Personal Data
Wishop processes personal data in compliance with the Protection of Personal Information Act (POPIA) and its Privacy Policy. Customers can read the full privacy policy at https://wishop.co.za/privacy-policy . Sellers may use Customer data only for order fulfilment and legal compliance.
12. Claim Management
- Initiating a claim – Customers can open a claim through their Wishop account.
- First reminder – If unresolved, Wishop sends a first reminder to the Seller within 48 working hours.
- Second reminder – If no Seller response, Wishop sends a second reminder within 24 working hours.
- Intervention – If the Seller fails to respond after two reminders, Wishop may step in to mediate a resolution.
13. Applicable Law and Competent Court
These Terms are governed by the laws of the Republic of South Africa. If disputes arise, the Parties must first attempt amicable resolution. Failing this, disputes fall under the exclusive jurisdiction of South African courts.
